Terms & Conditions
1. Definitions
“Accommodation” means the accommodation that You have booked through Us.
“Initial Deposit” means the deposit taken by Us from You when you book the Accommodation.
“Manager” means the person who manages the accommodation that You have booked.
“Owner” means the person who owns the accommodation that You have booked
“We”, “Us” and “Our” means Primary Rentals Limited and the business of the web site operated at www.primaryrentals.com .
“Web Site” means the web site operated at http://www.primaryrentals.com or such other variations of suffixes from time to time in force and any other web sites operated by Us.
“You” and “Your” means the person who has placed a booking for accommodation through Us.
2. Scope
These terms and conditions cover all of the contractual arrangements between Us and You.
3. Agent on behalf of Owner / Manager
We are acting as agents on behalf of the Owner or Manager of the Accommodation, in respect of the Initial Deposit and in respect of any other balances that we may take from You in the future. In that respect, our obligation is simply to take the deposit on behalf of the Owner or Manager and to introduce You to the Owner or Manager, with whom You will make arrangements directly for the payment of any rental balances, collection of keys, and other ancillary items such as bed linen, towels etc.
4. Treatment of Initial Deposit in event of non-availability
The Initial Deposit that we take from you at the time of booking by You of the Accommodation is a deposit towards booking the Accommodation for the dates specified. In this respect we have been informed by the Owner or Manager of the Accommodation that the Accommodation is available to be booked for those specified dates. In the event that the Owner or Manager should subsequently state that the Accommodation is not available for such specified dates, it is the obligation of the Owner or Manager to refund Your Initial Deposit. Whilst We are not under any contractual obligation to refund directly Your Initial Deposit, We will do everything in Our power to ensure You receive a full refund of the Initial Deposit
5. Treatment of Initial Deposit in all other circumstances
The Initial Deposit is non-refundable in all other circumstances other than non-availability of the Accommodation. It is Your obligation to liaise with the Owner or Manager after We have provided You with contact details and to organise payment of the rental balances within the time specified.
6. Your responsibility to ensure Accommodation is to Your satisfaction
It is Your absolute obligation to ensure that the Accommodation meets Your expectations. Should You be in any way not satisfied with the Accommodation, Your recourse in law is against the Owner or Manager of the Accommodation. We will nevertheless accept any comments or criticisms concerning any aspect of the Accommodation, and where appropriate We will take such action as We consider appropriate against the Owner or Manager of the Accommodation, which may include posting such comments on our Web Site, applying a negative score to their Trust Index, or removing the Accommodation altogether from the Web Site.
7. Accuracy of Information
Every effort is made to ensure that all information provided by Us is accurate and provided in a timely manner. We would nevertheless specifically draw Your attention to the fact that all individual Accommodation information is provided by the Owner or Manager of the Accommodation.
8. Liability limited
Notwithstanding any of the above, in the event that We have any liability to You, it is limited to the Initial Deposit that you have paid to Us. In the event that at any time in the future We take any additional sums above and beyond the Initial Deposit, Our liability in such cases will be limited to the aggregate sums paid by You to Us in respect of that booking.
9. Obligation to inform Us
Should You at any time subsequent to making this booking enter into any further contractual arrangement with the Owner or Manager of the Accommodation, it is Your absolute obligation to inform Us of such further contractual arrangement. This may include, but is not limited to, booking additional periods for the Accommodation, re-booking the Accommodation the following year or years, booking other Accommodation from the Owner or Manager, or agreeing to purchase this or any other property from the Owner or Manager. You understand that as an introducer of You to the Owner or Manager, We have a residual right to be paid commission on any subsequent transactions entered into between You and the Owner or Manager in respect of any transaction involving property. Should You knowingly fail to inform Us of such transactions after We have made enquiries to that effect, We have a right of recourse against You in law should our natural recourse against the Owner or Manager for any reason be unenforceable.
